General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions apply to all orders placed by consumers via the CoralPrime online shop at coralprime.de.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor attributable to their independent professional activity.

2. Offer and Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order.

The customer can place products in the shopping cart, review the information provided before completing the order, and correct it if necessary.

By submitting an order that requires payment, the customer makes a binding offer to conclude a purchase contract.

Receipt of the order will be confirmed electronically. The purchase contract is concluded when CoralPrime expressly confirms the order, accepts the payment, or begins processing the order.

In electronic commerce, customers must be able to identify and correct input errors before submitting the order; receipt of the order must also be confirmed electronically.

3. Contract Language and Storage of the Contract Text

The contract language is German.

The order details and the contractual terms applicable at the time of the order are processed electronically as part of the ordering process. The customer receives an order confirmation at the email address provided.

4. Prices and Payment

All prices stated in the online shop are final prices and include the applicable statutory VAT unless otherwise stated.

Additional shipping, packaging, or other costs expressly shown at checkout may apply.

The available payment methods are displayed to the customer during the ordering process.

Payment processing may in particular be carried out via Shopify Payments, PayPal, or other payment service providers offered at checkout.

5. WYSIWYG Corals

Corals marked as WYSIWYG (“What You See Is What You Get”) are individual specimens.

The customer generally receives exactly the animal shown in the individual product image.

Due to differences in lighting, camera settings, screen settings, as well as natural changes in a live animal, color, appearance, and polyp extension may differ slightly from how they appear on a screen.

Such technically or biologically caused differences do not in themselves constitute a defect.

6. Availability of Live Animals

Corals and other live animals are biological organisms. Despite careful husbandry, the condition or suitability for sale of an animal may change at short notice.

If an ordered animal becomes ill, is damaged, dies, or cannot be shipped for animal-welfare reasons before dispatch, CoralPrime reserves the right not to ship that animal.

The customer will be informed and will receive a refund of the purchase price paid for that animal.

There is no entitlement to delivery of a different animal as a replacement unless expressly agreed.

7. Delivery and Shipping

Delivery is made to the delivery areas enabled in the online shop. These are currently Germany, Austria, the Netherlands, Luxembourg, Belgium, Poland, Czechia, France, Spain and Denmark.

GO! Express is currently used for Germany, Austria, the Netherlands and Luxembourg. UPS Express is currently used for Belgium, Poland, Czechia, France, Spain and Denmark.

Possible delivery restrictions, available shipping methods and shipping costs are shown no later than during checkout. The current options shown at checkout and in the published Shipping Policy apply.

For live animals, the separate Shipping Policy and Live Arrival Guarantee conditions also apply. Live animals are shipped only using a suitable service.

8. Preferred Delivery Date for Live-Animal Shipping

For orders containing live animals, the customer may select an available preferred delivery date during checkout.

GO! Express dispatches Monday to Thursday and normally delivers Tuesday to Friday. UPS Express dispatches only Monday to Wednesday and delivers Tuesday to Thursday by the afternoon of the following day. There is no UPS dispatch on Friday, Saturday or Sunday; Monday is the first UPS dispatch day of the week.

The customer is responsible for ensuring that the parcel can be received on the selected date.

Local and regional public holidays and other foreseeable delivery obstacles at the destination must be considered when selecting the date. If such a public holiday is selected, delivery may take place on the next available working day. Delays and resulting harm caused by this are excluded from the voluntary Live Arrival Guarantee; statutory consumer rights remain unaffected.

A selected delivery date may be postponed for compelling operational, animal-health or transport-related reasons. CoralPrime will inform the customer where possible.

9. Local Pickup

Where offered at checkout, the customer may select local pickup.

No shipping costs apply to local pickup.

The customer will be notified when the order is ready or may follow the pickup conditions stated in the shop.

10. Shipping of Live Animals and Packaging

Live animals are professionally packed for the expected temperature.

This may include insulated polystyrene boxes, suitable transport bags and, depending on the weather, heat packs or cool packs.

The exact carrier, available destination countries, shipping costs and free-shipping thresholds are set out in the current Shipping Policy.

11. Live Arrival Guarantee

For the shipping of live animals, CoralPrime provides a separate Live Arrival Guarantee subject to the published conditions.

The Live Arrival Guarantee is an additional voluntary service and does not affect statutory warranty rights.

Details, in particular reporting deadlines, required photos or videos, and the type of possible reimbursement, are set out in the Live Arrival Guarantee conditions.

12. Statutory Rights in Case of Defects

Statutory rights in case of defects apply.

In the case of living organisms, natural development, growth, retraction of polyps, color changes, or changes after introduction into a different aquarium system are not automatically regarded as defects.

In particular, the condition and characteristics of the animal at the time of handover and the applicable statutory requirements are decisive.

13. Right of Cancellation

Consumers generally have the statutory right of cancellation unless a statutory exception applies.

Details are set out in the separate Cancellation Policy of the online shop.

For certain goods, in particular goods that are liable to deteriorate rapidly, Section 312g (2) of the German Civil Code (BGB) provides exceptions to the statutory right of cancellation.

Whether and to what extent such an exception applies to a particular product depends on the statutory requirements and the nature of the respective product.

14. Cancellation Before Shipping

If an order has not yet been processed or prepared for shipping, CoralPrime may agree to a cancellation request.

Any further statutory right of cancellation remains unaffected where such a right exists.

For shipments that have already been prepared for live-animal shipping or handed over to the carrier, short-notice cancellation may no longer be possible for organizational reasons.

15. Acceptance of Live-Animal Shipments

When ordering live animals, the customer must ensure that the shipment can be received on the agreed delivery date.

If proper delivery is prevented due to an incorrect or incomplete address for which the customer is responsible, absence, or refusal to accept delivery, resulting damage or additional costs may be charged to the customer to the extent permitted by law.

The conditions of the Live Arrival Guarantee may provide for limitations in cases of damage caused by a failed delivery for which the customer is responsible.

16. Retention of Title

The delivered goods remain the property of CoralPrime until the purchase price has been paid in full.

17. Liability

CoralPrime is fully liable in cases of intent and gross negligence as well as for damage resulting from injury to life, body, or health.

In cases of slight negligence involving the breach of essential contractual obligations, liability is limited to the typically foreseeable damage, to the extent permitted by law.

Mandatory statutory liability provisions remain unaffected.

18. Customer Information

The customer is required to provide complete and correct information during the ordering process.

In particular, for live-animal shipping, the delivery address, email address, and a reachable telephone number must be provided correctly where such information is required for proper delivery.

19. Changes to a Requested Shipping Date

If dispatch has to be postponed because of extreme temperatures, severe weather, transport disruption, public holidays, animal-health reasons or other circumstances that may endanger safe live-animal shipping, CoralPrime may postpone it to a suitable later date.

Animal welfare takes priority when deciding whether to ship. For local or regional public holidays at the destination, the provisions concerning the preferred delivery date and the voluntary Live Arrival Guarantee also apply.

20. Applicable Law

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

For consumers, this choice of law applies only insofar as it does not deprive them of mandatory consumer protection provisions of the country of their habitual residence.

21. Final Provisions

If individual provisions of these General Terms and Conditions are wholly or partially invalid, the remaining provisions remain unaffected.

The relevant statutory provisions shall apply in place of any invalid provision.
